This privacy statement is made on behalf of Jones Myers Pty Ltd ACN 628 468 137, trading as JM Property Co. (ABN 55 628 468 137), and all references to “we”, “us”, or “our” in this statement are references to JM Property Co. 

INTRODUCTION:

Your privacy is important to us. JM Property Co. recognises the importance of protecting the privacy and the rights of individuals in relation to their personal information. This document is our privacy policy, and it tells you how we collect and manage your personal information.

From time to time, we may find it necessary to change this Privacy Policy to reflect changes in the Federal Privacy Law or our commercial activities.  The latest version of our privacy policy may be obtained from our office on request.

We are bound by the Australian Privacy Act (1988) and the National Privacy Principals. Our procedures regarding personal information are designed to ensure that your rights are protected.

WHAT IS YOUR PERSONAL INFORMATION:

When used in this privacy policy, the term “personal information” has the meaning given to it in the Privacy Act. In general terms, it is any information that can be used to personally identify you. This may include your name, address, telephone number, and email address.  If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.

WHAT PERSONAL INFORMATION DO WE COLLECT AND HOLD? 

If you are a customer or potential customer of our agency, we may collect the following types of personal information about you:

  • name
  • mailing or street address
  • age or birth date
  • email address
  • telephone number
  • details of the services you have acquired from us or which you have enquired about, together with any additional information necessary to deliver those services and to respond to your enquiries
  • information you provide to us during telephone calls, in-person visits or in emails to our agents
  • we may be required by applicable laws, regulations or codes of conduct to verify your identity before we can provide our services to you. This may involve conducting a 100-point identity check, sighting a form of photographic identity such as drivers licence number or passport number and/or confirming your ownership of the property that you wish us to sell on your behalf.

HOW DO WE COLLECT YOUR PERSONAL INFORMATION?

We collect your personal information in several ways including but not limited to:  

  • directly from you when you make an enquiry about our services
  • during conversations between you and our employees
  • when you ask to be placed on one of our mailing lists
  • when you apply for a job with us
  • from your representatives (eg. solicitor, accountant or strata manager)
  • through our website and other electronic forms of communication
  • when you participate in a survey

WHY DO WE COLLECT YOUR PERSONAL INFORMATION?

We collect personal information about you so that we can perform our business activities and functions, and to provide quality of customer service.  We collect, hold, use and disclose your personal information for the following purposes:

  • processing inquiries
  • facilitating the sale, purchase, advertising of properties
  • recording persons entering a landlord or seller’s property (e.g. for inspection, survey or appraisal purposes)
  • facilitating the leasing of properties (including advertising the properties) and acting as property manager
  • providing property settlement services
  • for our internal business operations
  • complying with our legal obligations
  • advising clients of additional services or information which may be of interest
  • providing your contact details to our partners and contractors who provide us with services
  • maintaining and updating our business infrastructure and systems
  • statistical purposes
  • promoting and advertising our business, products and services
  • Your personal information will not be shared, sold, rented or disclosed other than as described in this privacy policy.

 

DATA MINIMISATION AND ACCURACY:

We only collect personal information that is necessary for the purposes outlined in this privacy policy. We take reasonable steps to ensure that the personal information we collect is accurate, complete, and up-to-date.

OPENNESS:

We will be open about how we handle your personal information. We will do this by,

  • telling you when we will or have collected personal information, what we will use the information for and to whom we may disclose it.
  • giving you more detailed explanation of our Privacy Policy when requested by you.
  • give you access to the personal information we hold about you when you ask for it.

You have the right to access the personal information that we hold about you under the National Privacy Principles.  Details of how to make a request for access are set out at the end of this Privacy Policy. A minimal fee may apply to cover any costs incurred by us in responding to your request such as photocopying and postage costs.

  • when we use it for the purpose for which it was collected, e.g. as part of a sale or leasing process or in the provision of another Service
  • to employees, contractors, and service providers who assist us in operating our business and providing our services
  • where disclosure is required or permitted by law
  • if disclosure will prevent or lessen a serious or imminent threat to someone’s life or health; or
  • where it is reasonably necessary for the enforcement of the criminal law, a law imposing a pecuniary penalty or for the protection of public revenue.

 

MANAGEMENT AND STORAGE OF PERSONAL INFORMATION:

We take reasonable steps to ensure your personal information is protected from misuse and loss and from unauthorised access, modification or disclosure.

We expect our staff to comply with certain standards of behavior when dealing with personal information. We train our staff about the need to protect your privacy and we will regard any unlikely breaches of the National Privacy Principles as serious matters.

Some of our records are paper based and are kept on secure premises away from the general public. We also keep some information in electronic format. Records that are kept in electronic format are kept within the secure computer system, which contains features such as password access and up to date virus protection.

We may keep personal information for up to 10 years after the completion of any documentation by you, for legal reasons. After that time, we will de-identify or destroy personal information in a secure way.

DATA BREACH NOTIFICATION:

In the unlikely event of a data breach that may compromise your personal information, we will notify you as soon as practicable and will take all necessary steps to mitigate the breach as required by applicable laws.

USER RIGHTS:

Under the Australian Privacy Act, you have the right to access, correct, and delete the personal information we hold about you. You also have the right to object to the processing of your personal information and to withdraw your consent at any time.
